  • Service refers to the Full Send website, API, and related infrastructure services operated by Spire Labs.
  • Device means any device that can access the Service such as a computer, smartphone, or tablet.
  • Website refers to Full Send, accessible from https://spire.dev/fullsend.
  • You means the individual or entity accessing or using the Service, as applicable.

2. Acknowledgment

These Terms and Conditions govern the use of our Service and form a legally binding agreement between You and the Company. By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not access the Service.

You represent that You are at least 18 years old. The Service is not intended for individuals under 18.

You acknowledge and agree that Spire Labs shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by reliance on any third-party content, products, or services.

We strongly advise You to review the terms and privacy policies of any third-party sites You visit.

4. Termination

We may suspend or terminate Your access to the Service immediately, without notice or liability, for any reason, including violation of these Terms.

Upon termination, Your right to use the Service will cease immediately.

5. Limitation of Liability

To the maximum extent permitted by law, the Company and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising out of or related to Your use or inability to use the Service.

Our total liability for any claim related to the Service shall not exceed the amount (if any) You paid to use the Service during the 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to You.

8. Dispute Resolution

Before initiating legal proceedings, You agree to first contact the Company and attempt to resolve any dispute informally.

Any unresolved disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Santa Clara County, California, United States.

9. U.S. and International Compliance

You represent and warrant that You are not (i) located in a country subject to U.S. embargo or sanctions, or (ii) listed on any U.S. government list of restricted or prohibited parties.

10. Severability and Waiver

If any provision of these Terms is held unenforceable or invalid, that provision shall be modified or interpreted to achieve its purpose to the fullest extent permitted, and the remaining provisions shall remain in effect.

Failure to enforce any right under these Terms shall not constitute a waiver of that right.

If a revision is material, we will provide notice (such as updating the “Last Updated” date). By continuing to access or use the Service after revisions become effective, You agree to be bound by the updated Terms.
